Cuty AI Terms of Service

1. Agreement

These terms form a binding agreement between you and Cuty AI. If you do not accept them, do not register and do not use the chat.

2. Definitions

"Service" means the Cuty AI website and companion chat. "Companion" means a fictional character available inside Cuty AI. "Member" means a person holding an account. "Content" means anything typed, uploaded or generated within the Service.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract. By using Cuty AI you confirm both statements are true and that local law permits your use of the Service.

4. What the service is

Cuty AI provides entertainment through conversational companions. It is not counselling, medical advice, legal advice, financial advice or an emergency service of any kind.

5. Fictional characters

Every Cuty AI companion is a fictional character. Names, photographs, biographies and personalities do not depict real individuals, and no companion represents a genuine relationship with a living person.

6. Creating an account

An account requires a valid email address or a supported sign-in provider. Information you supply during registration must be accurate and kept up to date.

7. Account security

You are responsible for your credentials and for everything done through your account. Tell us promptly if you suspect unauthorised access to your Cuty AI account.

8. One account per person

Members may hold one account. Accounts may not be shared, sold, transferred or operated on behalf of another person.

9. Free tier

Cuty AI offers a free tier with limits on daily messages, memory depth and companion count. We may adjust those limits, and the free tier is provided without any service commitment.

10. Paid memberships

Paid plans unlock additional capacity as described on the membership section of the site. Features listed for a plan apply for as long as that plan remains active.

11. Billing and renewal

Memberships are billed in advance and renew automatically for the same period until cancelled. Payment is taken by our processor using the method you supplied.

12. Cancellation

You may cancel at any time from your account settings. Access continues to the end of the period already paid for, after which no further charge is made.

13. Refunds

Charges are generally non-refundable once a billing period has begun. Where consumer law in your country grants a withdrawal right, that right applies and overrides this section.

14. Price changes

Prices may change. Existing members are notified before a new price applies to a renewal, and may cancel before that renewal takes effect.

15. Acceptable use

Use Cuty AI lawfully and for personal, non-commercial purposes. Do not interfere with the Service, other members, or the infrastructure the Service runs on.

16. Prohibited content

You must not submit content involving minors, non-consensual acts, real identifiable people presented sexually, threats, harassment, terrorism, trafficking or any other unlawful material. Breaches end the account immediately and may be reported to authorities.

17. No automated access

Scraping, crawling, reverse engineering, resale of output and any automated interaction with Cuty AI are prohibited without our written permission.

18. Your content

You keep ownership of what you write. You grant Cuty AI a limited licence to store and process it solely to operate the Service and deliver conversations to you.

19. Our intellectual property

The Cuty AI name, branding, interface, artwork, companion designs and site code belong to us or our licensors and may not be copied or reused without permission.

20. Feedback

Suggestions you send us may be used freely, without obligation, compensation or confidentiality, to improve Cuty AI.

21. Service availability

We aim to keep Cuty AI available continuously but do not guarantee uninterrupted access. Maintenance, upgrades and events beyond our control may cause downtime.

22. Changes to the service

Features may be added, altered or withdrawn as the product develops. Where a change materially reduces what a paid plan offers, we notify affected members in advance.

23. Suspension and termination

We may suspend or close an account that breaches these terms, abuses the Service, or exposes Cuty AI or its members to legal risk. Where practical we explain the reason.

24. Closing your account

You may delete your account at any time from settings. Deletion removes your profile, companion settings and conversation history and cannot be undone.

25. Disclaimers

Cuty AI is provided "as is". Generated replies may be inaccurate, inconsistent or unsuitable, and should never be relied upon as fact or professional guidance.

26. Limitation of liability

To the maximum extent permitted by law, our total liability arising from the Service is limited to the amount you paid to Cuty AI in the twelve months before the claim. We are not liable for indirect or consequential loss.

27. Indemnity

You agree to cover reasonable losses and costs we incur because you used Cuty AI unlawfully or in breach of these terms.

28. Governing law

These terms are governed by the laws of England and Wales, without prejudice to mandatory consumer protections available in your country of residence.

29. General provisions

If a section is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. These terms, with the Privacy Policy, form the entire agreement between you and Cuty AI.
